These are the official rules ("Rules") for the Infusionsoft "Pitch the Switch" Contest (the "Promotion"). If you participate in the Promotion, you ("Contestant") agree to comply with and be bound by the Rules.

Sponsor: The sponsor of the Promotion is Infusion Software, Inc. (dba "Infusionsoft"), 2065 W. Obispo Ave., Suite 103, Gilbert, AZ 85233. All questions regarding the Promotion should be directed by e-mail to pitchtheswitch@infusionsoft.com.

No purchase necessary: No purchase or payment is necessary to participate in the Promotion or win.

Jurisdictions: The Promotion is void where any aspect of the Promotion is prohibited by law or where registration, bonding or translation is required.

Objective: Infusionsoft wants to know why our customers switched from other systems (Act!, Outlook, Constant Contact, etc.) to Infusionsoft, and wants them to create videos for YouTube that discuss why they switched. October 1, 2010 is the official start of the contest. From October 1, 2010 until October 31, 2010, each Contestant is invited to post its video on YouTube and send us links to the video. The requirements for each video submission and the rules for determining the Promotion winners are set forth below:

Participation/Eligibility: Contestant must supply a valid email address as part of the registration process and other identification information as requested. No entries will be accepted after 11:59 p.m. Arizona Time, October 31, 2010 (the "Promotion Period"). Each Contestant must be at least the age of majority in his or her jurisdiction.

Each video entry must be "in good taste" and must comply with the following requirements (we reserve the right to reject any entry that, in our discretion, fails to comply with such terms or these Rules):

  1. Each video must be less than 4 minutes.
  2. Each video must answer the following questions: What system(s) were you using before Infusionsoft? Why did you switch to Infusionsoft? What were the results of switching to Infusionsoft?
  3. At the end of each video, the Contestant must say (or have written), "I made the switch. Join me for free at www.infusionsoft.com/switch."
  4. The video may not include inappropriate content under YouTube's terms of use.
  5. The video must be posted between 12:01 AM Arizona time on October 1, 2010 and 11:59 PM Arizona time on October 31, 2010.
  6. Only Infusionsoft's current subscription customers (must be a customer before the contest begins on October 1, 2010) are eligible to participate.
  7. Only one video entry per Infusionsoft account and/or business is eligible.
  8. Each Contestant must fill out an official registration form (found at: www.pitchtheswitch.com) before October 31, 2010 and provide a working link to the video submission.
  9. Each Contestant must agree to allow Infusionsoft full use and reproduction rights to the submitted video on behalf of the creator of the video and any persons or businesses appearing or referenced in the video.
  10. Each Contestant whose video receives an award must be willing, at our reasonable request, to re-record the submitted video with a professional videographer hired and paid for by Infusionsoft.
  11. Infusionsoft employees and members of their families and households are not eligible. Infusionsoft Affiliates, Certified Marketing Automation Coaches and partners are welcome to participate but must disclose their relationship to Infusionsoft in the video submission.
  12. Each Contestant must be able to provide documentation that supports any factual claims made in the video.

Submission Representations: Each Contestant warrants that (1) materials included in any entry are original with the Contestant (or that the Contestant has the right to submit such materials); (2) any person depicted in an entry is able to give, and has given, his/her full consent to participation and to the exploitation of the rights in the entry envisaged hereunder; (3) any music included in the entry is cleared for use as envisaged hereunder, and no further release needs to be obtained by Infusionsoft or any third party in relation to such exploitation; (4) the materials within the entry do not contain information considered by Contestant's place of business or any other third party to be confidential; and (5) the entry and all included materials do not violate or infringe the rights of any third parties or violate any laws or regulations.

Determination of Finalists: Once a video has been posted to YouTube, each Contestant is encouraged to post a blog about the contest, tweet, get Facebook "likes" and otherwise push traffic to the submitted YouTube video. Promptly following midnight (Pacific Time) October 31, 2010, the Infusionsoft marketing team will choose finalists based on total views on YouTube. The 10 videos with the most views on YouTube will be finalists. Infusionsoft will also select 5 more "wild card" videos as finalists. These may be selected based on "funniest video," "most heartfelt video," "best production," "most creative," etc. Wild cards will be chosen at the discretion of the Infusionsoft marketing team.

Determination of Winners: The 10 finalists and 5 wild cards will be notified by e-mail on November 1, 2010. They will then have their videos embedded on pitchtheswitch.com on or before November 2, 2010. Each finalist is encouraged to drive traffic to Infusionsoft's website where visitors can vote on their favorite video between 12:01 Arizona time on November 2, 2010 and 11:59 PM PT on November 15, 2010. Only one vote will be allowed per IP address. Winners will be selected based on most votes received, with the submission receiving the most votes the grand prize winner. Three runner ups will also be awarded.

Prizes: Grand prize winner will receive $10,000 from Infusionsoft and a year of Infusionsoft Basic for free. If Contestant uses a different version of Infusionsoft and/or has additional users, their Infusionsoft account will be credited $199 per month for one year in lieu of the year of Infusionsoft Basic. The free year of service or credit will begin January 1, 2011 and end December 31, 2011.

All Contestants who post a video, correctly submit their participation form and are not disqualified by Infusionsoft will receive a free copy of either Conquer the Chaos by Clate Mask and Scott Martineau or another book from our Infusionsoft library.

Winners will be notified on or before November 16, 2010 and winners will be posted on www.pitchtheswitch.com. Notifications and prize will be sent to the winner's address of record. If the notification or the prize cannot be delivered to such address, the prize may be forfeited and an alternative winner may be selected. For a winners' list, send a written request to Infusionsoft at the address set forth above. All decisions by Infusionsoft are final and binding in all matters relating to this Promotion.

Prizes may not be exchanged or altered in any way.

Limit of Liability: INFUSIONSOFT SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY LOSS, DAMAGE, COST, OR INJURY THAT ARISES FROM OR RELATES TO PARTICIPATION IN THE PROMOTION, OR WINNING OR USE OF A PRIZE, INCLUDING BUT NOT LIMITED TO: (I) LATE, LOST, DELAYED, DAMAGED, MISDIRECTED, INCOMPLETE, OR UNINTELLIGIBLE ENTRIES; (II) TELEPHONE, ELECTRONIC, HARDWARE OR SOFTWARE PROGRAM, NETWORK, INTERNET, OR COMPUTER MALFUNCTIONS, FAILURES, VIRUSES OR DIFFICULTIES OF ANY KIND; (III) FAILED, INCOMPLETE, GARBLED, OR DELAYED COMPUTER TRANSMISSIONS; (IV) THE DOWNLOADING OF ANY MATERIAL IN CONNECTION WITH THIS PROMOTION; OR (V) ANY OTHER CONDITION THAT MAY CAUSE THE PROMOTION TO BE DISRUPTED OR CORRUPTED. INFUSIONSOFT RESERVES THE RIGHT, IN ITS SOLE DISCRETION AND WITHOUT PRIOR NOTICE, TO SUSPEND OR CANCEL THE PROMOTION OR ALTER THE RULES FOR ANY REASONABLE REASON, INCLUDING, BUT NOT LIMITED TO, IF AT ANY TIME A COMPUTER VIRUS, TECHNICAL PROBLEM, OR OTHER UNFORESEEABLE EVENT ALTERS OR CORRUPTS THE ADMINISTRATION OF THE PROMOTION.

Release: CONTESTANT RELEASES AND AGREES TO INDEMNIFY AND HOLD HARMLESS INFUSIONSOFT AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, PARTNERS AND AGENTS FROM ANY LIABILITY WHATSOEVER FOR ANY CLAIMS, COSTS, LOSSES, OR DAMAGES (INCLUDING INFRINGEMENT OF PROPRIETARY RIGHTS, RIGHTS OF PUBLICITY OR PRIVACY OR DEFAMATION) ARISING OUT OF OR IN CONNECTION WITH: (I) THE ENTRY SUBMITTED BY CONTESTANT; (II) ENTERING AND PARTICIPATING IN THE PROMOTION; AND/OR (III) ACCEPTING OR USING ANY PRIZE. HOWEVER NOTHING IN THESE RULES SHALL LIMIT SPONSOR'S LIABILITY UNDER ANY CATEGORY OF LIABILITY WHICH UNDER THE LAW OF A CONTESTANT'S JURISDICTION CANNOT LAWFULLY BE LIMITED.

Governing Law: The Promotion and the rights and obligations of Infusionsoft and Contestants will be governed by and controlled by the laws of the State of Arizona, United States of America, applicable to contracts made and performed therein without reference to the applicable choice of law provisions. All actions, proceedings or litigation relating hereto will be instituted and prosecuted solely within the State of Arizona, Maricopa County. The parties consent to the jurisdiction of the state courts of Arizona and federal court located within such state and county with respect to any action, dispute or other matter pertaining to or arising out of the Promotion.

Privacy: Any Contestant information submitted as part of the registration process will be collected in accordance with Infusionsoft's Privacy Policy which can be found at http://www.infusionsoft.com/legal-stuff/privacy-policy.

Other Rules and Regulations: Contestants must abide by rules and regulations of all other networks used during this contest including YouTube. Infusionsoft reserves the right to change the rules as reasonably needed at any time. All Contestants will be notified of these changes by email if necessary.
